Liability In Bridgeview Motorcycle Accidents
Motorcyclists are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.6% of all vehicle miles traveled in the United States, motorcyclists accounted for 14% of all traffic fatalities, 18% of all occupant fatalities, and 4% of all occupant injuries in 2020.” There are a number of steps that drivers should take in order to avoid hitting motorcyclists.
- All drivers should check their blind spots before making turns.
- All drivers should maintain a safe distance with the vehicle ahead of them.
- All drivers should abstain from alcohol and other intoxicating substances.
Every driver must scan the road ahead of them and exercise due care in order to avoid collisions. Many car accidents are due to drivers that make dangerous left turns. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-902), the driver of any vehicle intending to turn left must first yield the right of way to any vehicle traveling from the opposite direction that is close enough so as to pose a hazard. If a pickup truck makes an abrupt left turn in front of a motorcyclist, this could form the basis of a negligence claim.
Depending on the facts of any case, liability for an accident could extend beyond an at fault driver. Many pickup trucks are used for commercial purposes such as landscaping and construction. If the driver of a pickup truck was working at the time of a collision, their employer could be held at fault. For example, a pickup truck driver may have been delivering materials. Victims of motorcycle accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Organ damage
- PTSD
Many accident victims may not realize the full extent of their injuries for some time after a collision. It is important to continue to seek medical care and document your injuries. Moreover, it is common for drivers to deny liability for any collision. It is also important that all relevant evidence is properly collected and preserved. Evidence will usually be necessary to demonstrate liability for any crash.
