Liability For Illinois Motorcycle Accidents

Thousands of people are killed or seriously injured in motorcycle accidents every year in the United States. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.6% of all vehicle miles traveled in the United States, motorcyclists accounted for 14% of all traffic fatalities, 17% of all occupant fatalities, and 3% of all occupant injuries in 2021.” There are a number of factors that could contribute to any car accident.

  • Speeding
  • Distracted driving
  • Dangerous turns
  • Roadway defects
  • Inclement weather

All drivers have a legal obligation to exercise due care in order to avoid hitting motorcyclists. Many motorcycle accidents involve drivers that make dangerous turns. Pursuant to Illinois Vehicle Code 625, no driver shall turn left through an intersection unless such a movement can be made with reasonable safety. They must yield the right-of-way to all traffic traveling from the opposite direction that is close enough to pose a hazard. Victims of motorcycle accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Many accident victims will need to take extensive periods of time off of work. They may also be left with medical bills. The full extent of a person’s injuries may not be apparent for several weeks or months after any collision. It is important for accident victims to remember that they do have rights. Any motorcyclist that is injured due to the negligence of another driver may have legal recourse through a civil claim.
