Liability for Madison County Motorcycle Accidents
Thousands of motorcyclists are killed or seriously injured every year in the United States. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.7% of all vehicle miles traveled in the United States, motorcyclists accounted for 14.6% of all traffic fatalities and 3.5% of all injuries in 2022. A factor that directly influences motorcycle fatality trends is helmet use.” Drivers should take a number of measures in order to prevent accidents.
- Drivers should slow down during adverse weather conditions.
- Drivers should not follow other vehicles at unsafe distances.
- Drivers should check their blind spots before changing lanes.
All drivers have a legal obligation to exercise due care in order to avoid hitting other vehicles. This requires that they operate their vehicle at a safe speed at all times. If a driver fails to slow down in order to avoid a collision, this could form the basis of a negligence claim. Victims of motorcycle accidents tend to suffer very serious and costly injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord trauma
Depending on the facts of any case, there could be numerous sources of liability for a motorcycle accident. The company that manufactured a motorcycle could be held at fault. Many collisions are caused by defective tires or stuck accelerators that prevent motorcyclists from being able to drive safely. Any person injured in a motorcycle accident may have legal recourse through a civil claim.
