Liability for Kendall County Motorcycle Accidents
Motorcyclists account for a relatively small portion of the total vehicles on the roadway. But they’re involved in a disproportionately high number of serious injury collisions. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.6% of all vehicle miles traveled in the United States, motorcyclists accounted for 15.5% of all traffic fatalities and 3.4% of all injuries in 2023.” Drivers should take many actions to avoid hitting motorcyclists.
- Scanning: Drivers should continuously scan the road ahead of them for motorcycles and other potential hazards.
- Speed: Drivers should always operate at a safe speed around motorcycles and other vehicles.
- Follow Distance: Drivers should always maintain a safe following distance with motorcycle riders and other vehicles.
Every driver has a legal obligation to exercise due care to avoid colliding with motorcycles in the roadway. Many motorcycle collisions involve drivers that make dangerous left turns. Pursuant to 625. Vehicles § 5/11-801, the driver of any vehicle intending to make a left turn at an intersection must first yield the right-of-way to any vehicle traveling from the opposite direction that is close enough so as to pose a hazard. If a driver makes a left turn into the path of another vehicle, they could be held at fault for the accident through a civil claim.
In certain circumstances. Liability for a collision could extend beyond any driver that is deemed to be responsible. This is particularly true if a vehicle was being used for commercial purposes. For example, a vehicle may have been used to transport passengers or goods through services such as Uber or Lyft. As a general rule, employers in Illinois are vicariously liable for the wrongful actions of their workers when those workers were acting within their job duties. It is important that certain actions be taken after any car accident.
- Victims should seek a thorough medical evaluation as early as possible. This is important even if the person involved feels as if they are alright.
- Photos of the accident site should be taken. These photos can help paint a clear picture of what happened.
- An experienced motorcycle accident attorney should be contacted. An attorney can help identify all potentially liable parties and get victims compensation to cover medical bills and lost wages.
The vast majority of car accidents are completely preventable. In far too many situations, drivers are fatigued, distracted, or simply not paying adequate attention to the road ahead of them. This is particularly common when drivers are making left turns. During these maneuvers, drivers must pay attention to two roadways at the same time. Any person injured in a motorcycle accident may be able to seek some measure of accountability through a civil claim.
