Liability for Winnebago County Motorcycle Accidents

Motorcycles make up a relatively small number of the total vehicles on the roadway. But they are involved in a disproportionately high number of serious injury collisions. According to the IIHS, “Motorcycles are less stable and less visible than cars and often have high performance capabilities. When motorcycles crash, their riders lack the protection of an enclosed vehicle, so they’re more likely to be injured or killed.” A number of different factors could contribute to a motorcycle accident.

  • Motorcycle accidents are more likely when drivers are making turns in the roadway.
  • Motorcycle accidents are more likely when drivers are speeding or otherwise not paying attention to traffic.
  • Motorcyclists are more vulnerable to roadway defects, such as potholes, which can cause a motorcycle to become unstable.

Drivers have a legal obligation to exercise due care in order to avoid hitting motorcycles and other vehicles in the roadway. Many of these collisions involve drivers that are making dangerous left turns. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-707), no person shall make a left turn or U-turn upon a roadway unless such a movement can be made with reasonable safety. Drivers that make dangerous turns into the path of a motorcyclist can be held liable in the event of a collision. It is important that certain steps are taken after any motorcycle accident.

  • Surveillance footage should be sought.
  • A police report should be conducted.
  • The circumstances leading up to the collision should be well understood.
  • Medical records related to the incident should be preserved.

It is possible that liability for any motorcycle collision extends beyond any driver. For example, if a pickup truck or other vehicle was being used for commercial purposes when an accident took place, the company that employed the driver could also bear some liability. Generally speaking, companies are vicariously liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. This may include transporting materials from one location to another.
