Liability In Mattoon Truck Accidents

By their very nature commercial trucks are much more dangerous than smaller vehicles. On average around 4,000 people are killed every year in accidents with commercial trucks. Trucks can weigh 20 – 30 times more than passenger vehicles. They also have a much higher ground clearance which makes underride collisions more likely.  There are a number of factors that could contribute to truck accidents including:

  • Speeding
  • Drunk driving
  • Distracted driving
  • Inclement weather

Rear-end collisions are the most common type of accident. They are also the most preventable.  Pursuant to Illinois Vehicle Code (625 ILCS 5/11-710), “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the traffic upon and the condition of the highway.” There is a rebuttable presumption of negligence on any driver that hits another vehicle from behind. There are a number of steps that should be taken after any truck accident.

  • Eye witnesses should be interviewed.
  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • Any truck involved in an accident should be examined.

When a truck driver is negligent and causes an accident, they can be held liable. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Many truck accident victims may not realize the full extent of their injuries until several weeks or months after an accident. It’s important that victims continue to seek medical care. It’s also important for them to discuss their case with an experienced Illinois truck accident attorney. An attorney can examine all of the unique facts of your case and let you know what your legal options are.
