Liability for Tampico School Bus Accidents
School buses are considered common carriers and must operate with a great deal of care to avoid collisions, as indicated under the Common Carrier Liability Act (740 ILCS 25/). According to Illinois Vehicle Code 625 ILCS 5, “A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety.” Multiple factors could contribute to a school bus accident.
- Speeding: School bus drivers are substantially more likely to lose control of their vehicles at higher speeds.
- Poor Road Conditions: Defects in the roadway could cause a driver to veer off the roadway.
- Inclement Weather: A number of vehicles are involved in collisions due to weather. This is particularly common after it has started raining.
If a school bus driver fails to operate their vehicle with the safety and care necessary to avoid collisions, this could form the basis of a negligence claim. There is a presumption of negligence on the part of any driver that leaves the roadway and collides with some fixed object. Liability for a collision could extend beyond any driver deemed to be at fault. The private company or municipal entity that a school bus driver worked for could also bear some liability for a crash.
Steps to Take After Whiteside County School Bus Accidents
School buses are typically very safe for their passengers. But they are still involved in many injury collisions each year. According to the National Safety Council, “School bus-related crashes killed 128 people nationwide in 2023, up 23% compared to the 104 deaths in 2022, according to National Safety Council (NSC) tabulations of data from the National Highway Traffic Safety Administration (NHTSA).” Any person injured in a school bus accident should take certain actions.
- Victims should seek a thorough medical evaluation.
- Eyewitnesses should be interviewed early on.
- The police report created after the collision should be sought.
- An experienced Illinois bus accident attorney should be contacted.
Buses are difficult vehicles to operate. It is vital that bus drivers receive extensive training. Accidents involving school buses are often highly preventable. In many cases, they involve drivers that are distracted or not traveling at a safe speed. Any person injured in a school bus accident may be able to seek some measure of accountability through a civil claim. Damages can help cover lost wages, medical bills, and pain and suffering.
