Peoria County officials are saying that the accident took place around 6:15 p.m. on Friday. Nancy Massey was traveling down the road in an SUV when a pickup truck driven by a 30-year-old man crossed the center line and hit her vehicle head-on.
The force of the collision caused both vehicles to rollover. Paramedics were called to the scene to help the victim.
Nancy Massey was taken to the hospital, but there is no word yet on her condition. A full investigation into the Peoria County collision remains ongoing at this time.
The driver of the pickup truck was cited for improper lane usage and for failing to reduce speed to avoid a collision.
Liability for Peoria County Head-On Collisions
Motor vehicle accidents remain a leading cause of preventable injury and death in the United States. According to the U.S. Department of Transportation, “In 2021, 43,230 people were killed in motor vehicle crashes, of which 7,388 were people walking. Millions more were injured – sometimes permanently – each year. This was the highest number of fatalities since 2005.” Head-on collisions can be particularly dangerous. They account for roughly 2% of all collisions but over 10% of all traffic fatalities. These accidents may happen for a variety of different reasons.
- Speeding: Drivers are much more likely to lose control of their vehicle at higher speeds.
- Fatigue: Many collisions are due to fatigued drivers. The CDC estimates that staying awake for only 17 hours can reduce a person’s ability to operate their vehicle safely equal to driving with a BAC of 0.05%.
- Vehicle System Failures: In many cases, a catastrophic system failure in a vehicle could cause it to veer wildly off course. This is particularly common when a vehicle has a tire blowout.
Drivers have a legal obligation to exercise due care to avoid hitting other vehicles in the roadway. Many collisions are caused by drivers that make unsafe lane changes. Pursuant to 625 ILCS 5/11-709, “A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety.” There is a presumption of negligence on the part of any driver that hits another vehicle head-on after entering into opposing lanes of traffic.
Depending on the facts of any case, liability for a car accident could extend beyond any driver. This is particularly true if the vehicle involved was being used for commercial purposes. It is fairly common that pickup trucks and certain vans are on the road for a business purpose. If that is the case, the company that employed the driver operating one of these vehicles could potentially be held at fault for the crash. It is important that certain steps are taken after any car accident.
- Eyewitnesses should be interviewed.
- All medical records related to an accident should be preserved.
- Surveillance footage should be sought.
- The cause of the accident should be determined.
The vast majority of accidents are preventable. They tend to involve drivers that violate traffic regulations. Unfortunately, drivers and their insurance providers will often do everything in their power to deny responsibility for collisions. This is why it is so important that these incidents are properly investigated and evaluated by an outside party. Any person that is injured due to the negligence of another person may be able to seek some measure of justice through a civil claim.
