Liability for Elgin Dump Truck Accidents
Thousands of people are killed or seriously injured in truck accidents every year. According to the National Safety Council, “In 2023, 5,375 large trucks were involved in a fatal crash, an 8.4% decrease from 2022 but a 43% increase in the last 10 years. The involvement rate per 100 million large-truck miles traveled is down 8% from 2022, but up 22% in the last 10 years.” There are a number of factors that can make dump trucks particularly dangerous.
- Blind Spots: Dump trucks have large blind spots that can easily obscure the presence of pedestrians and smaller vehicles.
- Stopping Distance: A fully loaded dump truck traveling at 65 mph can take the length of two football fields to come to a complete stop.
- Turning Radius: Dump trucks have a wide turning radius and are thus more likely to be involved in side-impact collisions.
Dump truck drivers must exercise a great deal of care in order to avoid colliding with other vehicles. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-709, a vehicle shall be driven as practically within a single lane and shall not be moved from that lane until the driver is able to ascertain that the movement can be made with reasonable safety. If a driver crosses into opposing lanes of traffic and collides with another vehicle, this could form the basis of a negligence claim. It is important that evidence is properly preserved after any truck accident.
- The work records of any truck driver involved should be reviewed.
- Photos of the accident site should be taken.
- All medical records related to injuries should be preserved.
- An experienced truck accident attorney should be contacted.
If a truck driver was working at the time of a collision, their employer could potentially be held at fault. As a general rule, employers are vicariously liable for the wrongful actions of their employees–insofar as those employees were working within the course and scope of their job duties. This may include situations where truck drivers are moving goods from one location to another.
