Liability for DeKalb County Semi-Truck Accidents
Semi-trucks can weigh 80,000 lbs and have a tall ground clearance. This makes them particularly dangerous for the occupants of passenger vehicles. According to the Association for the Advancement of Automotive Medicine, “The FARS database from 1994–2010 shows that, over this 17-year period, a total of 30,243 fatalities occurred in light vehicles as a result of collisions with combination trucks. This finding results in an average of 1,779 fatalities per year in light vehicles due to collisions with combination trucks. Of these, 311 fatalities per year were side impacts with a combination truck, and 68 of those fatalities were side underrides.” Truck companies should take many steps to prevent truck accidents.
- Underride Guards: Truck companies should install underwrite guards on their vehicles. This can help protect drivers from becoming wedged underneath the truck.
- Technology: Truck companies should consider installing safety features such as forward collision avoidance systems.
- Compliance: Truck companies should make sure that all of their drivers have the appropriate commercial license and a clean driving record.
- Maintenance: Truck companies should ensure that all of their vehicles are periodically inspected and properly maintained.
Truck drivers must operate with an abundance of caution to avoid causing accidents. They owe a duty of care to every other person on the road to obey traffic regulations and slow down to avoid collisions. Pursuant to 625 ILCS 5/11‑904, every driver of a vehicle approaching a stop intersection shall stop at a clearly marked stop line. They must then proceed to yield the right-of-way to any driver that is close enough so as to pose a hazard.
Liability for a truck accident could be complex and extend to several parties. This includes the company that owned or operated a truck involved in a collision. When a company hires a truck driver to perform tasks, they will typically be responsible for the negligent actions of that driver. This will normally be true as long as the truck driver was operating within the scope of their job responsibilities. However, truck companies will often hire drivers as “independent contractors” to limit their legal exposure. Victims of truck accidents tend to suffer very serious injuries.
- Broken Bones: The impact from a truck collision often cause numerous fractures in a person’s wrists, arms, legs and ribs.
- Head Injuries: The sudden deceleration from a vehicle coming into contact with a truck can cause a person’s head to violently jolt forward and hit objects. This can result in a traumatic brain injury.
- Organ Damage: Many of the injuries associated with truck accidents are not outwardly visible. Accident victims may suffer damage to their internal organs.
Even after the physical injuries associated with a truck accident heal, many people suffer long-term psychological injuries. This includes anxiety, depression, and long-term PTSD. It can be hard to know where to begin after any truck accident. However, accident victims should understand that they do have rights after being injured due to the negligence of a truck driver. They can hold that driver accountable through a personal injury claim. These claims can help cover lost wages, medical bills, and pain and suffering.
