Liability for Will County Semi-Truck Accidents

Semi-truck drivers are required to get a commercial driver’s license and must operate with an abundance of caution to avoid colliding with other vehicles. They must maintain a safe follow distance with any vehicles ahead of them. Pursuant to 625 ILCS 5/11-710, “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the traffic upon and the condition of the highway.” Rear-end collisions tend to happen for a variety of different reasons.

  • Truck drivers may be fatigued and simply not paying adequate attention to the road ahead of them.
  • Truck drivers may have been traveling too fast for the prevailing conditions.
  • Truck drivers may have been intoxicated by alcohol or some other substance.

There is a presumption of negligence on the part of any driver that collides with the rear of another vehicle in their own lane of traffic. When a truck driver is involved in a collision, their employer could also potentially be held at fault. As a general principle, companies are held liable for the wrongful actions of their workers operating within the course and scope of their job duties. However, many truck companies try to limit their legal exposure to accident claims by hiring drivers as “independent contractors.”

Preventing Illinois Semi-Truck Accidents

Truck accidents seriously injure or kill many people each year. According to the National Safety Council, “In 2023, 5,375 large trucks were involved in a fatal crash, an 8.4% decrease from 2022 but a 43% increase in the last 10 years. The involvement rate per 100 million large-truck miles traveled is down 8% from 2022, but up 22% in the last 10 years.” Truck companies should take several measures to prevent collisions.

  • Maintenance: Semi-trucks have a high utilization rate. These vehicles must be routinely inspected and well-maintained to function safely.
  • Training: All truck drivers should receive adequate training so that they know what to expect when they are on the road.
  • Technology: Trucks can be equipped with a variety of safety features, including Ford collision avoidance systems.

The vast majority of truck accidents are preventable and involve some amount of negligence. Part of the problem is that truck drivers often push their workers to adopt unsafe driving habits. In fact, one in ten truck drivers involved in a fatal collision reported feeling under pressure from their carrier. Any person that is injured in a truck accident may be able to seek some measure of accountability through a personal injury claim.
