Liability for Accidents Involving Children’s Toys

There has been a growing trend of toy products entering into the United States and Europe that contain asbestos and other contaminants.  According to the European Environmental Bureau, “All children tested in one large-scale project were found to be contaminated with phthalates at levels that were a risk to health in 13 out of 15 countries. Kids were on average twice as contaminated as their mothers, and sometimes much more contaminated, up to 12 times more.” Companies should take several steps to avoid contaminants from entering their toys.

  • Toy manufacturers should periodically inspect and test all of the toys they’re intending to sell.
  • Toy manufacturers must abide by all federal and international safety standards.
  • Toy manufacturers should do everything in their power to tightly control the production process.
  • Toy manufacturers should only source materials from reputable buyers.

Toy manufacturers have a legal obligation to ensure that all of their products are reasonably safe. A toy manufacturer can potentially be liable for injuries involving their product if it contains some type of defect. For example, a toy could contain asbestos or other contaminants. This may occur because manufacturers are sourcing materials from areas with known contamination. Product liability claims are typically pursued as a strict liability offense. A manufacturer can be liable if their product is defective, even if they exercise a great deal of care to avoid harm. Several steps should be taken after any accident involving defective toys.

  • The product that was defective should be stored in a secure location where it is not likely to cause additional harm.
  • All medical records related to a person’s treatment should be sought.
  • It should be determined whether or not the product involved in the incident was on any recall lists.
  • Victims should consult with an experience product liability attorney.

Asbestos can cause very serious and lasting health consequences. This includes mesothelioma, which is a cancer that affects the lungs. Unfortunately, toy manufacturers will virtually never accept responsibility if one of their products is defective or causes injury to the public. This is why it is so important victims consider their legal options with an experienced attorney. An attorney can examine the unique facts of your case free of cost and let you know if you have an injury claim that can be pursued.
