Liability for Injuries Caused by Consumer Products

Companies that create consumer products must ensure that they are reasonably safe. They must test them and all of the ways that they’re likely to be used and misused. At a bare minimum, these devices should function as intended. When a consumer product has a defect that contributes to an injury, this could form the basis of a product liability claim. Most product liability claims based on negligence will allege one of three types of defects.

  • Design Defects: A product may have design defects if the defects are inherent and exist before the product is manufactured.
  • Manufacturing Defects: A product may have manufacturing defects if only certain units out of all manufactured have flaws.
  • Marketing Defects: A product may have marketing defects if it lacks adequate instructions or warnings about latent dangers with the product.

Product liability claims are often pursued on the basis of strict liability. Under strict liability, a defendant can be liable for a plaintiff’s injuries if the plaintiff is able to demonstrate that the product is defective. They will be liable even if they exercised great care to avoid harm. A court may hold that a product is not defective if there is evidence that the utility of the product outweighs any inherent risk of harm.

Steps to Take After Injuries Caused by Consumer Products

Many consumers are injured every year in accidents involving consumer products. According to the Consumer Product Safety Commission, “In 2020, an estimated 28,535,000 people sought medical attention for an injury related to, but not necessarily caused by, a consumer product. This is a decrease of more than 7.7 million (21 percent) from the 2019 estimate.” Any person injured by a defective consumer product should take several actions to protect their health and rights.

  • Medical Evaluation: Victims should seek a thorough medical evaluation. Many of the injuries associated with consumer products will not be immediately obvious.
  • Evidence Preservation: The product that caused the injury should be stored in a safe location so that it can be evaluated.
  • Legal Support: Any person injured in an accident caused by a consumer product should seek the guidance of an experienced product liability attorney. An attorney can examine the unique facts of your case and let you know what your legal options are.

It is important for victims of faulty consumer products to understand that they do have legal options. They are able to seek some measure of accountability through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering. There are no upfront charges to hiring a product liability attorney. They get paid by the opposing party if they are able to successfully resolve your case.
