Ozark Trail 64 oz Stainless Steel Insulated Water Bottles Recalled Over Injury Risk

CHICAGO, ILLINOIS (July 28, 2025) – Walmart has issued a recall for the popular Ozark Trail 64 oz Stainless Steel Insulated Water Bottles because they can injure consumers.

The recall was issued on July 10, 2025. Roughly 850,000 units were sold prior to the recall.

According to the Consumer Product Safety Commission, the lid of the water bottle can forcefully eject on certain occasions. This can pose a serious impact and laceration hazard as consumers are attempting to open it.

This is particularly true if the water bottles are being used to carry juice, milk, or carbonated beverages. Walmart has received at least three reports of consumers who have been injured by ejecting lids.

Two of those victims sustained permanent vision loss after they were hit in the eye. The Ozark Trail 64 oz Stainless Steel Insulated Water Bottles were initially manufactured in China.

Liability for Injuries Caused by Consumer Products

Injuries involving consumer products are actually quite common. According to the Consumer Product Safety Commission, “In 2020, an estimated 28,535,000 people sought medical attention for an injury related to, but not necessarily caused by, a consumer product. This is a decrease of more than 7.7 million (21 percent) from the 2019 estimate. The 2020 age-adjusted rate of injury was 8.5 medically treated, consumer product-related injuries per 100 people in the U.S. resident population. The 2019 age-adjusted estimate was 10.9 per 100.” There are many steps that companies should take to prevent their products from potentially becoming dangerous.

  • Companies should thoroughly test their products and all the ways that they will be used and even misused.
  • Companies should take into consideration the age of the people likely to use their products.
  • Companies should ensure that their products are reasonably sturdy and not likely to break apart.

Every company that manufactures products for consumers has a duty of care to avoid creating products that are unreasonably dangerous. When a company creates a product that is unreasonably dangerous, this could form the basis of a product liability claim. There are three primary defects alleged in product liability claims. A product may have designed defects if the problems with it exist before it is manufactured. A product will typically have manufacturing defects if the issue with the product is due to some flaw in the manufacturing process. Products have marketing defects when they lack proper instructions or fail to warn consumers about latent dangers. There are several elements that must be demonstrated in any prima facie case of product liability.

  • The defendant sold the product that was used by the plaintiff.
  • The defendant was the commercial seller of the product.
  • The plaintiff sustained an injury while using the product.
  • When the defendant sold the item to the plaintiff, it was already defective.
  • The defect was the actual and proximate cause of the plaintiff’s injury.

It could be hard to know what to do if you’ve been injured by a consumer product. Unlike car accidents, there is not an obvious party with an insurance policy to go after from the perspective of a consumer. However, consumers can take legal action when they’re injured by dangerous products. They can pursue damages through a civil claim to recover for lost wages, medical bills, and pain and suffering. A product liability attorney can examine all of the unique facts of your case and let you know what your legal options are.
