Liability For Des Plaines Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured every year in the United States. According to the Centers for Disease Control, “Higher vehicle speeds increase both the likelihood of a pedestrian being struck by a car and the injury severity. Most pedestrian deaths occur in urban areas, on roadway locations away from intersections (where higher speeds might occur), and at night.” There are a number of factors that could contribute to a car accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Poor road conditions
  • Driver fatigue

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Many pedestrian accidents are due to drivers that are speeding. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Many accident victims may not realize the full extent of their injuries for several weeks or months after a collision. In particular, pedestrians who are injured often suffer from long term psychological injuries. It can be difficult to know what to do after any collision. But it is important to remember that accident victims do have rights.
