Saint Clair County officials are saying that the accident took place around 3:30 AM on Thursday. A woman may have been walking when she was hit by a vehicle.
That driver did not remain at the scene. Paramedics were called to the scene to help the 33-year-old victim.
Despite life-saving measures, she was pronounced deceased after being taken to a local hospital. A full investigation into the cause of the collision remains ongoing at this time.
Liability for Belleville Pedestrian Accidents
Drivers have a legal obligation to use caution to avoid colliding with any pedestrian in the roadway. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horns when necessary and exercise the proper precautions to avoid colliding with any child or obviously confused person. There are a number of factors that may contribute to pedestrian crashes.
- Speed: A large portion of pedestrian collisions occur because drivers are speeding.
- Driver Distraction: Another factor that may contribute to pedestrian collisions is driver distraction. Many drivers hit pedestrians as they are looking at their phones.
- Driver Intoxication: Pedestrian collisions may also be due to drivers that are intoxicated. But what many drivers don’t realize is that a number of substances besides alcohol could potentially impair their ability to operate a vehicle safely.
If a driver flees the scene of an injury collision, they could face criminal charges in addition to civil liability. Depending on the facts of any case, there should be numerous sources of liability for a pedestrian collision. This is particularly true if a driver was working at the time of a crash. A driver may have been working for Uber or on their way to a business meeting.
Steps to Take After a Hit-and-Run Collision
Thousands of pedestrians are killed or seriously injured in hit-and-run collisions each year. According to the AAA Foundation for Traffic Safety, “In 2016, there were 1,980 fatal hit-and-run crashes resulting in 2,049 fatalities. This is the highest annual number of hit-and-run fatalities or crashes recorded since NHTSA began compiling statistics on fatal motor vehicle crashes in 1975.” Several steps should be taken after any hit-and-run collision.
- Investigation: A thorough investigation into the collision should be conducted. Even small fragments of a flaming vehicle left behind could help track down the driver.
- Photos: Photos of the accident site should also be taken. They can provide an enormous amount of insight into what happened.
- Surveillance Footage: It is also a good idea to determine if any surveillance cameras may have captured what happened. Surveillance footage can provide clear details of what may have led up to a crash.
It can be hard to know where to begin after any pedestrian accident. Victims are often left with serious injuries and may need to take extensive periods off work. To make matters worse, the drivers responsible for hit-and-run collisions rarely come forward to accept responsibility for what took place. The family of any pedestrian killed in a car accident may be able to seek some measure of accountability through a wrongful death claim.
