Liability for Cook County Pedestrian Accidents
Drivers have a legal obligation to exercise caution to avoid colliding with any pedestrian in the roadway. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, “every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian, or any person operating a bicycle or other device propelled by human power and shall give warning by sounding the horn when necessary and shall exercise proper precaution upon observing any child or any obviously confused, incapacitated or intoxicated person.” There are many ways that a driver may have acted negligently.
- A driver may have failed to scan the road ahead of them for pedestrians.
- A driver may have failed to check the blind spots before turning into an intersection.
- A driver may have failed to slow down when a pedestrian is nearby.
- A driver may have failed to maintain their vehicle in a safe condition.
Drivers must slow down to avoid hitting pedestrians, even if those pedestrians are outside of marked crosswalks. When a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Depending on the facts of any case, liability for a pedestrian collision could extend beyond any driver deemed to be at fault. The business that operated a tow truck could be liable for a collision. In general, employers can be liable for the wrongful conduct of their workers who were operating within the course and scope of their job duties.
Steps to Take After Illinois Pedestrian Accidents
Many pedestrians are killed or seriously injured every year across Illinois in the United States. According to the IIHS, “A total of 7,314 pedestrian deaths occurred in 2023. Pedestrian fatalities account for 18% of all crash fatalities. Pedestrian deaths in 2023 have increased 78% since reaching their lowest point in 2009.” Several steps should be taken after any pedestrian accident.
- Photos of the accident site should be taken.
- Medical records related to injuries should be preserved.
- The history of collisions at the intersection should be understood.
- An experienced pedestrian accident attorney should be contacted.
Pedestrian accidents are often highly preventable. They tend to involve situations where drivers are violating one or more traffic regulations. Unfortunately, drivers and their insurance providers will virtually never accept responsibility when they cause collisions. This is why it is so important that these incidents are investigated by an independent party.
