Liability for Accidents Involving Faulty Gym Equipment
Many people are injured in accidents involving gym equipment each year. According to one report by the Daily Mail, “Exercise equipment like treadmills, stair steppers and medicine balls sent almost half a million Americans to the emergency room in 2022, according to a new analysis. Roughly 445,642 people visited the hospital in 2022 because of gym equipment, while another 719,335 required treatment for injuries related to basketball and cycling, combined.” There are many ways that gym equipment may be defective.
- Subpar Materials: Gym equipment could be made of subpar materials that are prone to breaking.
- Faulty Design: Gym equipment may fall apart due to improper assembly.
- Inadequate Warnings: Gym equipment may lack adequate warnings about dangers associated with using it.
Companies that manufacture gym equipment have a legal obligation to ensure that it is reasonably safe. They must take into consideration all of the ways that their equipment could be used and even misused. If a piece of gym equipment has design defects that cause consumers to be injured, the company that manufactures the equipment could be responsible through a product liability claim. In certain situations, a manufacturer could be responsible if a defect during the manufacturing process is the root of the problem.
Steps to Take After Being Injured by Gym Equipment
It can be difficult to know where to begin after being injured in any accident involving gym equipment. Victims often sustain serious injuries and may need to take extensive periods of time away from work. They may also be burdened with high medical bills. Any person injured by gym equipment should take certain actions to protect their health and legal rights.
- Medical Evaluation: Victims should seek a thorough medical evaluation. Many of the injuries associated with an accident will not be immediately obvious.
- Evidence Preservation: All of the evidence related to the accident should be preserved. This should include the device that caused the injury. It should be stored in a secure location where it is not likely to cause additional harm.
- Legal Support: Victims should seek the guidance of an experienced product liability attorney. An attorney can examine the unique facts of your case and let you know what your legal options are.
The vast majority of accidents involving gym equipment are totally preventable. They tend to be the result of poor design decisions on the part of manufacturers. Part of the problem is that many of the devices that cause injuries are manufactured in countries where safety regulations may not be as strict. Any person injured by a faulty piece of gym equipment may be able to seek some measure of accountability through a personal injury claim.
