Liability For Bolingbrook Hit-And-Run Semi-Truck Accidents

Thousands of people are killed or seriously injured in semi-truck accidents every year. According to the Insurance Institute for Highway Safety, “A total of 4,714 people died in large truck crashes in 2021, a 17 percent increase compared with 2020. Sixteen percent of these deaths were truck occupants, 68 percent were occupants of cars and other passenger vehicles, and 15 percent were pedestrians, bicyclists or motorcyclists.” There are a number of factors that make semi-trucks especially dangerous for pedestrians.

  • Semi-trucks have large blind spots that can obscure the presence of pedestrians and smaller vehicles.
  • Semi-trucks can weigh as much as 80,000 lbs making even low speed collisions potentially deadly.
  • A fully loaded semi-truck can take the length of two football fields to come to a stop.

Semi-truck drivers are held to a high standard as operators of commercial vehicles. They must follow all rules and regulations laid out in Title 49 of the Code of Federal Regulations. Many truck accidents are due to truck drivers that were speeding. If a semi-truck driver fails to slow down to avoid hitting pedestrians, this could form the basis of a negligence claim. Truck drivers that flee the scene of injury collisions could also face criminal sanctions.

The company that a truck driver worked for could potentially bear some liability for a collision. In general, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course of their job duties. For example, a truck driver may have been delivering goods when they crashed. There are a number of steps that should be taken after any semi-truck accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Fragments of any  fleeing vehicle should be sought.
  • A thorough investigation should be conducted.

Many hit-and-run truck accidents occur because the truck driver was simply not paying attention to the road. It can be hard to know where to begin after any semi-truck accident. But it is important for accident victims to know that they do have rights. The family of any person that is killed in a semi-truck accident may have legal recourse through a civil claim. Sadly, though, truck companies will often fight hard to deny liability for any collision.
