Liability For Eagle Point Township Car Accidents
Distracted driving is one of the leading causes of car accidents in the United States. According to the Centers for Disease Control, “In the United States, over 3,100 people were killed and about 424,000 were injured in crashes involving a distracted driver in 2019. About 1 in 5 of the people who died in crashes involving a distracted driver in 2019 were not in vehicles―they were walking, riding their bikes, or otherwise outside a vehicle.” There are many other factors that could contribute to car accidents.
- Poor road conditions
- Driver fatigue
- Inclement weather
- Vehicle system failures
All drivers must exercise due care in order to avoid causing car accidents. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1204(b), the driver of any vehicle must obey all stop signs. They must stop at the stop sign before entering the crosswalk or, if there is no crosswalk, at a marked stop line. There is a rebuttable presumption of negligence on the part of any driver that hits a vehicle after disregarding a stop sign. There are a number of steps that should be taken after any car accident.
- Surveillance footage should be sought.
- Medical records should be preserved.
- The police report for the crash should be examined.
- A thorough investigation should be conducted.
It can be difficult to know where to begin after any car accident. Many victims suffer life-altering injuries and may need to take time off of work. Any person that is injured in a car accident may be able to seek some measures of justice through a civil claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is important that all evidence is preserved after any collision.
