Liability for Injuries Caused by Consumer Products
Companies that create chairs or other consumer products have a legal obligation to ensure that they are reasonably safe. They must be made of sturdy material that is not likely to break during normal use. To that end, manufacturers must test their products in all of the ways that they are likely to be used and even misused. There are many different ways that a consumer product could be defective.
- A consumer product may have designed defects that are inherent to the way that it is created. For example, the legs on a chair may be poorly placed so that a person’s weight is not evenly distributed.
- A consumer product may have manufacturing defects if only certain units are likely to malfunction. Manufacturing defects may occur due to defective machinery.
- A consumer product may have marketing defects if they failed to warn consumers about the non-obvious dangers associated with their product.
When a company fails to create a product that is reasonably safe that injures a consumer, they could be liable for the accident through a strict liability claim. Many accidents involving consumer products are the result of companies that make deliberate safety shortcuts. They may choose to manufacture their products with subpar material. It is more likely to break or malfunction.
Steps to Take After Being Injured by Consumer Products
Falls remain a leading cause of preventable injury and death, particularly for older adults. According to the Centers for Disease Control, “One out of 10 falls results in an injury that causes the older adult to restrict their activities for a day or more or to seek attention from the healthcare system. Each year, there are about 3 million emergency department visits due to older people falls.” Any person injured by a consumer product should take certain steps to protect their health and rights.
- Victims should seek a thorough medical evaluation.
- Victims should preserve the consumer product that injured them.
- Victims should determine if the profit of them was on any recall lists.
- Victims should seek the guidance of an experienced product liability attorney.
It can be hard to know what to do after being injured by a consumer product. Many people blame themselves for accidents. But the fact of the matter is that many of these accidents are the results of poorly designed products that needlessly cause harm. Any person injured by a faulty consumer product may be able to seek some measure of justice and accountability through a personal injury claim.
