Liability for Illinois Motorcycle Accidents
Fatal motorcycle accidents have unfortunately been increasing in recent years across the state of Illinois. According to the Illinois Department of Transportation, “Illinois experienced a 20.2% increase in fatal motorcycle crashes in 2021, compared to the previous four-year average, and experienced a 9.8% increase in a year-over-year comparison from 2020 to 2021.” Taller SUVs and trucks can be particularly dangerous for motorcyclists.
- Blind Spots: Larger vehicles tend to have large blind spots that can easily obscure the presence of motorcyclists.
- Longer Stops: Larger vehicles tend to also have much longer stopping distances, thereby making certain types of collisions more common.
- Poor Maneuverability: Larger vehicles are more difficult to operate and less maneuverable than smaller vehicles. They can’t easily swerve to avoid hazards in the roadway.
All drivers have a legal obligation to use caution to avoid colliding with other vehicles on the roadway. Many truck accidents involving motorcycles take place because the truck driver made a dangerous left turn. Pursuant to Illinois Statutes Chapter 625. Vehicles § 5/11-90, the driver of any vehicle attempting to turn left in the roadway must first yield the right-of-way to any vehicle traveling from the opposite direction close enough to pose a hazard. If a truck driver turns into the path of a motorcyclist, this could form the basis of a negligence claim.
Depending on the facts of any case, there could be numerous liable parties for any car accident. A municipal entity could potentially be liable for a collision if it was caused by some defect in the roadway. For example, obscured traffic signals could potentially make it difficult for multiple vehicles to navigate an intersection safely. It is also possible that a pothole could cause a driver to lose control of their vehicle. It is important that the circumstances of any collision are properly understood.
- Photos of the accident site should be taken.
- Medical records related to injuries should be preserved.
- Surveillance footage from traffic cameras or nearby businesses should be sought.
- The actions of any truck driver leading up to a crash should be scrutinized.
The vast majority of motorcycle accidents are preventable. They tend to involve drivers that are simply not paying adequate attention to the road ahead of them. In particular, many drivers simply overlook motorcyclists and pedestrians due to their small profile. Sadly, the drivers responsible for these collisions will often do everything in their power to deny responsibility. This is why it is so important that accidents are thoroughly investigated by an outside party.
