Liability For Batavia Car Accidents
Bicyclists are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the Centers for Disease Control, “Bicycle trips make up only 1% of all trips in the United States. However, bicyclists account for over 2% of people who die in a crash involving a motor vehicle on our nation’s roads.” There are a number of common causes of bicycle accidents.
- Speeding
- Distracted driving
- Inclement weather
- Poor road conditions
The vast majority of bicycle accidents are preventable and involve some amount of driver error. According to Illinois Vehicle Code 625 ILCS 5/11-601, no person shall operate a motor vehicle at a speed greater than would be reasonable or prudent given the prevailing conditions of the roadway. If a driver fails to slow down to avoid hitting a bicyclist, this could form the basis of a negligence claim. There are a number of steps that should be taken after any car accident.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
Bicycle accidents are often the most difficult thing that a person can go through. Victims tend to suffer very serious injuries and may need to take extensive time off of school and work. Any person that is injured in a car accident due to the negligence of another driver may have legal recourse through a civil claim. It is important that all evidence is preserved after any collision.
