Liability for Dalton City Car Accidents
Every driver in Illinois has a legal obligation to exercise due care to avoid collisions with other vehicles. Pursuant to 625 ILCS 5/11-709, “A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety.” Drivers should take several measures to prevent accidents.
- Blind Spots: Drivers must continuously check their blind spots before changing lanes or making turns in the roadway.
- Vehicle Attachments: Drivers must ensure that all cargo or attachments to their vehicle are properly secured.
- Speed: Drivers must maintain a safe speed that takes into consideration the prevailing road conditions and traffic hazards.
- Scanning: Drivers must continuously scan the road ahead of them and take action to either slow down or maneuver away from potential hazards.
If a driver fails to safely stay in their lane of traffic and is hit by another vehicle, this could form the basis of a negligence claim. Negligence is the failure to behave with the level of care that a reasonable person would have taken in the same situation. This includes situations where a driver is distracted by their cell phone or otherwise traveling at an unsafe speed for the prevailing conditions.
Liability for Accidents Involving Farm Equipment
Car accidents remain one of the leading causes of preventable injury and death in the United States. According to the U.S. Department of Transportation, “In 2021, 43,230 people were killed in motor vehicle crashes, of which 7,388 were people walking. Millions more were injured – sometimes permanently – each year. This was the highest number of fatalities since 2005.” When farm equipment is involved in an accident, there could be several sources of liability.
- Equipment Owner: Under Illinois law, the owner of a vehicle or piece of heavy machinery can be liable for an accident if they allow another person to drive it and that person is involved in a crash.
- Farm Owner: The owner of a farm or related business could be liable for a collision. As a general principle, employers can be held vicariously liable for the wrongful actions of their workers who were operating within the course and scope of their job duties.
- Municipal Entity: A city or county could also be liable for a collision if it was caused by a dangerous condition on public property. If a city has constructive notice of a dangerous condition with their property and fails to act, this could be considered negligence.
The vast majority of motor vehicle collisions are preventable. They tend to involve situations where drivers are failing to follow traffic regulations. Part of the problem is that many employers push their workers to complete routes as quickly as possible. This can lead to them adopting unsafe driving habits that jeopardize everyone on the roadway. It is important for accident victims to understand that they do have rights if they’re injured in a crash. These rights extend to the family member of any person who was killed. Surviving family members are able to seek some measure of justice and accountability through a wrongful death claim.
