Liability for Calhoun County Propane Tank Explosions
Companies that create propane tanks have a legal obligation to ensure that they are reasonably safe. They must comply with all state and federal regulations. If a company creates a propane tank that has a tendency to leak gas or malfunction in some critical way, this could be construed as negligence. There are several potential defects with any propane tank that could contribute to an explosion.
- Corrosion: A propane tank may be poorly constructed in such a way that it is likely to corrode. This can compromise the structural integrity of the tank and make explosions more likely.
- Faulty Pressure Release Valve: A propane tank may have a faulty pressure release valve that fails to properly release excess pressure.
- Improper Welds: The welds on a propane tank may be insufficient and cause a catastrophic failure in certain scenarios.
When a company creates a device with design defects, they could be liable for any resulting injuries through a product liability claim. A manufacturer of a propane tank could also be liable for an accident on the basis that they failed to warn consumers about latent danger. Products should have adequate warnings that let users know about likely risks.
Steps to Take After Propane Tank Explosions
Many people are killed or seriously injured every year in accidents involving propane tanks. According to the Consumer Product Safety Commission, “Propane gas is highly flammable. Each year, about 600 fires/explosions occur with gas grills resulting in injuries to about 30 people. The new safety standard for propane gas tanks requires that an “over-fill prevention device” be installed in new gas tanks.” It is important that certain actions are taken after any propane tank explosion.
- Medical Evaluation: Victims should seek a thorough medical evaluation and treatment for all of their injuries. Many of the injuries associated with an accident will not be immediately obvious.
- Evidence Preservation: The propane tank involved in the accident should be preserved. It should also be determined if it was on any recall list.
- Notify Authorities: The fire department should be notified of the incident so that they can conduct an investigation.
- Legal Review: Any person injured in an explosion should seek the guidance of an experienced personal injury attorney. An attorney can review the unique facts of your case free of cost and let you know what your legal options are.
It can be difficult to know where to begin after a propane tank explosion. Victims are often left with catastrophic injuries that require painful skin grafts. The medical costs to treat these injuries can be completely overwhelming. It is important that any person injured in a propane tank explosion carefully consider their legal options with an experienced attorney. Victims are able to seek some measure of justice and accountability through a personal injury claim.
