Liability for Edwards County Oilfield Explosions

When a worker is injured in Illinois, they will normally have recourse through the workers’ compensation system. This is a no-fault insurance scheme that provides benefits to injured workers. There is no need for an injured worker to demonstrate that one party was at fault. An injured worker may also be able to pursue damages through a third-party liability claim if an entity separate from a worker’s employer contributed to an accident. There could be numerous sources of third-party liability for an oilfield explosion accident.

  • Equipment Manufacturers: The company that manufactured equipment used in an oilfield could potentially be held at fault through a product liability claim if that equipment was faulty in some way.
  • Contractor and Subcontractors: Within the construction and oil industries, it is common for any worksite to have multiple layers of contractors and subcontractors. If any explosion was the result of unsafe work practices from these entities, this could form the basis of a negligence claim.
  • Property Owners: It is common for oilfields to be leased by oil companies. The landowners that actually control these oilfields could be held at fault through a premises liability claim. Property owners have a legal obligation to maintain their premises in a reasonably safe condition and must remedy hazardous conditions on their premises.

It is important that evidence is properly preserved after any oilfield explosion. Evidence can help reveal safety lapses that may have contributed to any incident. This is particularly important for injured employees. Finding third-party liability sources can help victims recover substantially more compensation for their injuries.

Common Causes of Oilfield Explosions

Accidents at oilfields remain a substantial hazard for workers in this industry. According to the Centers for Disease Control, “Oil and gas extraction (OGE) industry contract workers incur more work-related severe injuries compared with workers in other industries, based on data from the Occupational Safety and Health Administration.” There are many common causes of explosions at oilfields.

  • Gas Leaks: There are many volatile gases at oilfields, including methane. Any type of gas leak could potentially lead to an explosion.
  • Ignition Sources: All explosions require an ignition source. If there is any type of welding or cutting near flammable materials, this could spark an explosion.
  • Equipment Failures: If the machinery and equipment used to transport materials in oilfields fail, this could also cause an explosion. In particular, there may be some type of malfunction with a blowout preventer (BOP).

Oilfield explosion accidents can leave victims with serious injuries. Burn injuries, in particular, can be extremely painful and require expensive skin graft surgeries. Accident victims should strongly consider all of their legal options. They may be able to pursue damages through a civil claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
