Liability for Chicago Apartment Fires

Property owners in Illinois have a legal obligation to protect guests from foreseeable sources of harm. They must abide by all building codes and work to address known safety deficiencies. When a property owner has actual or constructive knowledge of a dangerous condition with their property, they must take action. Failing to take action could form the basis of a premises liability claim. There are several actions that apartment owners must take to protect from fires.

  • Smoke Detectors: All apartments should come equipped with functioning smoke detectors.
  • Fire Extinguishers: Apartments should have fire extinguishers throughout the building.
  • Lighting: Lit escape signs should appear throughout any apartment. This may be the only thing clearly visible during a fire with heavy smoke.
  • Maintenance: All of the electrical wiring in an apartment must be routinely inspected and in good condition.

Even if an apartment fire is not preventable, there are still steps that can be taken to warn guests of impending danger so that they can exit to safety. It is important for victims of apartment fires to understand that they do have legal rights. They are able to seek some measure of accountability through a civil action. This extends to the family of any person who died in an apartment fire. Family members can seek some measure of accountability through a wrongful death claim.

Steps to Take After a Chicago Apartment Fire

Residential fires remain a major cause of preventable injury and death. According to the National Fire Protection Association, “During this five-year period, US fire departments responded to an estimated average of 328,590 home structure fires per year. These fires caused an annual average of 2,600 civilian deaths; 10,770 civilian fire injuries; and $8.9 billion in direct property damage.” Any person affected by an apartment fire should take key actions to protect their health and legal rights.

  • Medical Evaluation: It is important to receive a medical evaluation after a fire. Most of the damage from a fire does not come from burns. It is the result of lung damage from smoke.
  • Investigation: There should be a thorough investigation into the cause of the fire. Any report that lists the cause should be collected and preserved.
  • Legal Review: Any person affected by an apartment fire should carefully consider all of their legal options. Victims are able to seek justice and accountability through a civil claim.

It can be hard to know where to begin after any apartment fire. Victims may lose all of their earthly possessions in the fire. In more serious cases, they may sustain major injuries or lose a family member. To make matters worse, property owners will virtually never accept responsibility for a fire. They are more likely to shift the blame to third parties. This is why it is so important to have these events properly investigated by an outside party.
