Liability for Neoga Semi-Truck Accidents

When a semi-truck driver is injured or killed in Illinois, they or their family will typically have recourse through the workers’ compensation system. The workers’ compensation system operates through a no-fault insurance plan. There is no need for an injured worker to demonstrate that one party was at fault. The family of an injured truck driver may also have recourse through a third-party liability claim. There could be numerous sources of third-party liability for any truck accident.

  • Truck Company: If a second truck driver contributed to an accident, their employer could be held at fault. Generally speaking, companies are vicariously liable for the wrongful actions of their workers who are operating within the course and scope of their job duties.
  • Truck Manufacturer: The company that manufactured a truck could also be liable for a collision if some defect with the truck caused an accident. For example, the tires or brakes on a truck could malfunction and cause a truck driver to lose control.

Truck drivers are required to exercise a great deal of caution to avoid collisions. Pursuant to 625 ILCS 5/11-1003.1, every driver must slow down to avoid colliding with any pedestrian in the roadway. They must be particularly cautious around any child or person who appears to be confused. If a box truck driver fails to slow down to avoid colliding with any pedestrian, this could form the basis of a negligence claim.

Steps to Take After an Illinois Truck Accident

Commercial trucks account for a relatively small portion of the total vehicles on the road. But they are involved in a high number of serious injury collisions. According to the National Safety Council, “in 2023, 114,552 large trucks were involved in crashes resulting in an injury, a 4.7% decrease from 2022. Since 2016, the number of trucks involved in injury crashes has increased 12%, while the involvement rate per 100 million large truck miles driven has remained the same at 35.” It is important that certain actions are taken after any truck accident.

  • Police: The police should be called to the scene so that they can begin an investigation into the accident.
  • Photos: Photos of the accident site should be taken. These photographs can help paint a picture of what took place.
  • Medical Records: All medical records related to injuries should be collected. These can reveal the extent of the injuries that a person sustained.

Most commercial trucks have event data recorders (EDRs). These devices can establish what a truck driver was doing in the moments leading up to a collision. Unfortunately, when a truck driver causes an accident, their employers and insurance providers will do everything that they can to deny responsibility for what happened. In these situations, it is important for accident victims to seek experienced legal counsel.
