Liability for Coles County Truck Accidents

Car accidents remain one of the leading causes of serious injury and death in the United States. According to the NHTSA, “There were 716 fewer people killed in motor vehicle traffic crashes on U.S. roadways during 2022, a 1.7-percent decrease from 43,230 in 2021 to 42,514 in 2022. The fatality rate per 100 million vehicle miles traveled (VMT) decreased by 3.6 percent from 1.38 in 2021 to 1.33 in 2022.” Many different factors could contribute to a car accident.

  • Speeding: A large portion of car accidents involve at least one driver who is speeding. Drivers are much more likely to lose control of their vehicle at higher speeds.
  • Intoxication: Another common cause of car accidents is driver intoxication. What many drivers don’t realize is that many different substances could potentially impair them besides alcohol, including prescription medications.
  • Inclement Weather: Any period of inclement weather can substantially increase the likelihood of a car accident. Many drivers are simply unaccustomed to driving during hazardous conditions.

Concrete truck drivers are required to get a commercial license and operate with an abundance of caution to avoid collisions. One of the major dangers of concrete trucks is that they have long stopping distances. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-710, the driver of a motor vehicle shall not follow another vehicle more closely than would be reasonable and prudent given the prevailing conditions of the roadway. If a truck driver fails to slow down to avoid hitting another vehicle, this may be construed as negligence.

Liability for any truck collision could extend beyond an at-fault driver. Their employer could potentially be held at fault. Generally speaking, employers are vicariously liable for the wrongful actions of their workers operating within their job duties. This will typically include instances where a truck driver was transporting goods from one location to another. Certain steps should be taken after any truck accident.

  • The actions of the truck driver leading up to the crash should be understood.
  • The condition of the truck involved in the crash should be investigated.
  • Surveillance footage that may have captured the collision should be reviewed.
  • An experienced truck accident attorney should be contacted.

Truck accidents are often highly preventable. Part of the problem is that truck drivers often adopt unsafe driving practices. For example, many truck drivers failed to check their blind spots before making certain maneuvers. To make matters worse, companies that operate commercial trucks will usually do everything in their power to avoid responsibility for any injuries or deaths that they cause. It is important that accident victims understand that they do have legal options. Any person injured due to the negligent actions of a truck driver may be entitled to damages through a personal injury claim.
