Liability for Chicago Transit Authority Bus Accidents

Bus companies in Illinois are considered common carriers and must operate with a great deal of caution to avoid causing accidents. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-902, “The driver of a vehicle intending to turn to the left within an intersection or into an alley, private road, or driveway shall yield the right-of-way to any vehicle approaching from the opposite direction which is so close as to constitute an immediate hazard.” Bus companies should take several measures to avoid collisions.

  • All bus drivers should have a commercial license and be well trained.
  • Buses should be repeatedly inspected and well maintained.
  • Bus drivers should be afforded periodic rest breaks throughout their work schedule.

If a bus driver fails to slow down to avoid colliding with another vehicle, this could form the basis of a negligence claim. Liability for the collision could also extend beyond any particular driver determined to be at fault. The private employer or municipal entity that a bus driver worked for could also be held at fault. Generally speaking, employers are liable for the wrongful actions of their workers who were operating within the course and scope of their job duties.

Steps to Take After Chicago Bus Accidents

Many people are seriously injured every year in car accidents across Illinois and the United States. According to the National Safety Council, “Between 1913 and 2023, motor-vehicle deaths per 10,000 registered vehicles decreased 95%, from 33 to 1.57, respectively. In 1913, only 1.3 million vehicles were registered, and 4,200 people died on the road. In 2023, 285 million vehicles were registered, and 44,762 people died on the road.” Several steps should be taken after any bus accident in Chicago.

  • Victims should seek medical attention early on.
  • Victims should let their employers know if they were injured on the job.
  • Victims should take plenty of photos of the accident site.
  • Victims should contact an experienced personal injury attorney.

A fully loaded bus can weigh tens of thousands of pounds. These vehicles are dangerous even at lower speeds. It can be difficult to know what to do after a bus accident. Many victims are left with serious injuries. It is important that the victims of these collisions understand that they do have options. They’re able to seek some measure of justice and accountability through a personal injury claim.
