Liability For Joliet Bus Accidents

Many people are seriously injured or killed in bus accidents each year. According to the Journalist’s Resource, there are about 63,000 bus accidents every year. These accidents result in around 63,000 injuries and 325 fatalities on average. Most of the victims are either pedestrians or in smaller passenger vehicles. There are several reasons that buses can be particularly dangerous.

  • Buses have large blind spots that can obscure the presence of smaller vehicles.
  • Buses take much longer to stop than smaller vehicles.
  • Buses have a much wider turning radius than smaller vehicles.

Buses are considered “common carriers” under the Common Carrier Liability Act (740 ILCS 25/) and are there fore held to a high standard in terms of safety. Many collisions are due to bus drivers that make dangerous left turns. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-902), any driver intending to turn left must first yield the right-of-way to any driver traveling from the opposite direction that is close enough so as to pose a hazard. Victims of bus accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

If a bus driver was working at the time of a collision, the company that they were working for could be held at fault. Generally speaking, companies are typically liable for the wrongful acts of their employees – insofar as those employees were working within the course and scope of their job duties. Any person that is injured due to the negligence of a bus driver may have legal recourse through a bodily injury claim. A bus accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
