Liability For Lincoln Plane Crashes
Commercial aircraft tend to be very safe. There are many years where there are no fatalities in United States based commercial aviation. The vast majority of plane crashes take place in private aviation. Smaller planes tend to lack many of the redundancies found in commercial planes such as dual engines. There are a number of factors that could contribute to any plane crash.
- Mechanical malfunctions
- Air traffic controller negligence
- Aircraft design defects
- Improper aircraft maintenance
If a plane or its component parts malfunctioned prior to a crash, this could form the basis of a product liability claim. Plane manufacturers have a legal obligation to make products that are reasonably safe. They can be liable for design, manufacturing and marketing defects associated with their products. Many design defects can cause the engine of a smaller plane to stall unexpectedly. There are a number of steps that should be taken after any plane crash.
- Photos of the accident site should be taken.
- Surveillance footage should be sought.
- Medical records should be preserved.
- A thorough investigation should be conducted.
Any person that is injured in a plane crash may have legal recourse through a civil claim. Damages in a civil claim can help cover many of the expenses that come with a plane crash. It is important that all evidence is properly preserved after any accident. Evidence is what will ultimately be used to determine liability for any crash.
