Liability for Carbon Monoxide Poisoning Accidents
Carbon monoxide is an odorless and colorless gas. It is responsible for many injuries and deaths every year. According to JAMA, “Unintentional carbon monoxide (CO) poisoning causes approximately 2100 deaths in the United States per year, but the use of CO detectors could potentially prevent many of these deaths.” There are a number of symptoms associated with carbon monoxide poisoning.
- Headache
- Dizziness
- Nausea
- Shortness of breath
- Drowsiness
Depending on the facts of any case, a vehicle manufacturer could potentially be liable for a carbon monoxide poisoning accident. It is possible for carbon monoxide poisoning to occur inside of a vehicle. This typically takes place due to faulty exhaust systems, defective ventilation systems, or possibly emissions from other vehicles. For example, Ford has faced lawsuits after numerous law enforcement officials were injured in carbon monoxide poisoning due to faulty systems with their vehicles. It is important that certain steps are taken after any carbon monoxide poisoning accident.
- Any vehicle that may have been involved in the CO poisoning should be inspected.
- Medical records related to the incident should be preserved.
- A thorough investigation should be conducted.
The vast majority of carbon monoxide poisoning accidents are completely preventable. Nearly all can be prevented when there are CO detectors inside of a home. However, it is very hard to stay protected if the source of the CO poisoning is coming from inside of a vehicle. It is important for accident victims to understand that they do have legal options. In particular, the family of any person who died in a CO poisoning accident may have legal recourse through a wrongful death claim.
