Liability for Little Village Construction Accidents
Falls remain one of the leading causes of serious injury and death for workers in the United States. According to OSHA, “In 2023, there were 421 fatal falls to a lower level out of 1,075 construction fatalities (BLS data). These deaths are preventable. […] When working from heights, employers must plan projects to ensure that the job is done safely. Begin by deciding how the job will be done, what tasks will be involved, and what safety equipment may be needed to complete each task.” Several actions should be taken to protect workers from falls.
- Assessment: Construction companies should conduct a fall assessment to identify all potential fall risks.
- Fall Protection: Construction companies should use safety barriers to protect workers from falls, including guardrails and toe boards.
- Equipment: Construction companies should ensure that all of their workers have adequate fall protection equipment.
When a worker is injured in Illinois, they will typically have recourse through workers’ compensation. Workers’ compensation operates through a no-fault insurance scheme. There is no need for an injured worker to demonstrate that one party was responsible for their injuries to receive benefits through workers’ compensation. An injured worker may also be able to receive benefits through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident.
There are numerous potential sources of third-party liability at a construction site. This includes the owner or operator of a building. Property owners have a legal obligation to ensure that their premises are in a reasonably safe condition. General contractors may also bear some liability if they fail to maintain a worksite in a safe condition. It is important that certain steps are taken after any workplace accident.
- Medical Evaluation: Injured workers should receive a thorough medical evaluation. Many of the injuries associated with a workplace accident may not be obvious. Injured workers should also inform their doctors that they were injured on the job.
- Evidence Preservation: Injured workers should gather as much evidence as they can from the accident site. They should include taking photos of the scene and collecting any official reports made by OSHA.
- Legal Counsel: Injured workers should seek the guidance of experienced legal counsel. An attorney can help workers receive the compensation and benefits that they need to recover.
It can be hard to know what to do for any person injured at their job. This is particularly true when a worker is injured in a fall. False can leave workers with traumatic injuries that impair workers ability to be gainfully employed. Even after a worker heals, lingering injuries may physically limit what a worker is able to accomplish in the long term. It is important that accident victims understand that they do have legal options. They are able to seek some measure of accountability through a civil action.
