Liability for Quincy Pedestrian Accidents
All drivers in Illinois must exercise caution to avoid colliding with any person in the roadway. Pursuant to 625 ILCS 5/11-1003.1, “every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian, or any person operating a bicycle or other device propelled by human power and shall give warning by sounding the horn when necessary and shall exercise proper precaution upon observing any child or any obviously confused, incapacitated or intoxicated person.” There are many ways that a driver may have failed to exercise due care to avoid colliding with a pedestrian.
- Speeding: A driver may have been traveling at an unsafe speed for the prevailing road conditions.
- Blind Spots: A driver may have failed to check their blind spots before turning at an intersection.
- Distractions: A driver may have been distracted by their phone or other objects.
Depending on the facts of any case, there could be numerous liable parties for any truck accident. This is particularly true if a pickup truck or van was involved in the collision. Pickup trucks are routinely used for commercial purposes. If a pickup truck was being used for business purposes, the company that owned or operated the truck could be liable. Employers can be vicariously liable for the wrongful actions of their employees who were operating within the course and scope of their job duties.
Steps to Take After Illinois Pedestrian Accidents
Many people are killed or seriously injured every year in pedestrian collisions. According to the Centers for Disease Control, “Over 8,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2022. That’s about one death every 64 minutes. There were also an estimated 140,000 emergency department visits of pedestrians treated for non-fatal crash-related injuries in 2022.” Certain actions should be taken after any pedestrian collision.
- Police Investigation: The police should be called to the scene of the collision as early as possible so that they can begin an investigation.
- Surveillance Footage: Many pedestrian crashes are captured by surveillance footage. This can be enormously helpful in determining what led up to a crash.
- Site Review: It should be determined if the street or intersection where the accident took place had a history of similar incidents.
- Legal Review: Any person injured in a pedestrian accident should seek the legal guidance of an experienced pedestrian accident attorney. An attorney can review the facts of your case and let you know what your legal options are.
Pedestrian accidents are often highly preventable. This is particularly true at intersections. Drivers routinely fail to check their blind spots and hit pedestrians as they make unsafe turns. It is vital that victims understand that they do have legal options. They are able to seek some measure of accountability through a civil claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
