Liability for Attacks in Cook County Parking Lots
Attacks and other violent incidents in parking lots remain all too common. According to the United States Department of Justice, “Because parking facilities are more likely settings for crime—both violent and property—than all other real estate except residential, security is one of the most critical issues facing the owners and operators of parking facilities today. Local government officials are also concerned about the security of these facilities—some of which are city owned or operated—because parking affects the economic viability of a community.” There are a number of steps that businesses can take in order to make parking lots safer.
- Businesses can install bright lights to ensure that parking lots are well illuminated even at night.
- Businesses can install security cameras that cover all areas of a parking lot.
- Businesses can hire security officials to patrol parking lots.
- Businesses can trim bushes and other foliage that might create blind spots where crime is more likely to occur.
Property owners have a legal obligation to protect their residence from reasonably foreseeable sources of harm. This includes protecting guests from criminal activity. The level of security that businesses may need will depend largely on the unique history of any property. Businesses in high-crime areas with a known history of attacks may need a great deal of security. A bingo hall at a retirement center where little to no crime takes place might need little to no security measures. It is important that certain steps are taken after any attack in a Walmart parking lot.
- Surveillance footage should be sought.
- The history of attack and criminal activity in the parking lot should be investigated.
- A police report of the incident should be created.
- The circumstances leading up to the incident should be well understood.
Walmart has faced a number of lawsuits for attacks and shootings that have occurred on their premises. In many of these instances, there were a number of attacks and other events that led up to the incident being litigated. Sadly, though, Walmart has proved time and time again that they will do everything in their power to deny liability if someone is injured on their premises. It is important for assault victims to know that they do have legal rights protected by the law. The family of any person who is killed in an attack at a Walmart parking lot may be able to seek some measure of accountability through a civil claim.
