Liability For Huntley Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured in pedestrian accidents every year. According to Patch, “In Illinois, pedestrians died at a rate of 1.59 per 100,000 in 2022, according to the report, which is below the national average and Illinois was among a large number of states that saw decreases in pedestrian deaths between 2021 and 2022.” There are a number of factors that could contribute to car accidents.

  • Accidents are more likely to occur when drivers are speeding.
  • Accidents are more likely to occur when drivers are distracted.
  • A large portion of collisions take place at intersections.
  • Inclement weather can obscure the presence of pedestrians.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to 625 ILCS 5/11-1002, the driver of any vehicle must yield the right-of-way to any pedestrian that is crossing in a marked crosswalk. If a driver fails to reduce their speed in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian collisions tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

The vast majority of pedestrian accidents are preventable and involve some amount of driver error. This could include speeding or making dangerous turns in an intersection. Depending on the facts of any case, a pedestrian injured in a car accident may be able to seek some measure of justice through a civil claim. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
