Liability for Huntley Workplace Accidents

Falls are one of the leading causes of workplace injury and death in the United States. According to the Centers for Disease Control, “In 2022 falls from elevation represented approximately 81% of all fatal and 20% of all nonfatal slips, trips, and falls for all industry workers (BLS 2023a, BLS 2023b).  Many of these falls occurred in the construction industry, and significantly impact construction employers, workers, and their families.” Companies should take a number of measures to protect workers from falls.

  • Hazard Assessment: Companies should conduct a fall hazard assessment to identify all potential fall hazards.
  • Training: Companies should ensure their workers are properly trained to identify fall hazards.
  • Equipment: Companies should provide all of their workers with personal fall arrest systems (PFAS) when they are working on elevated platforms at 6 feet or higher.

Every company with employees in Illinois must acquire workers’ compensation insurance. This insurance offers help to all workers who are injured on the job. Liability is not taken into consideration when determining what workers can receive benefits. In addition to workers’ compensation insurance, an injured worker may be able to receive benefits through a third-party liability claim.

A third-party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident. There are many sources of potential third-party liability at any manufacturing plant. For example, a property owner could face liability if their premises were in a dangerous condition and this contributed to an accident. A property may have lacked adequate fall protection systems such as guardrails. Victims of workplace falls tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage
  • Spinal cord injuries

It can be hard to know what to do for any person seriously injured in any workplace accident. Many of these accidents result in serious trauma that can lead to permanent disabilities. Workers may not be able to return to their positions for several weeks or even months. In many cases, a worker may be so seriously injured that they’re never able to return to their previous profession. Injured workers are protected by a number of laws. They are able to seek some measure of accountability through a civil claim.
