Liability For Accidents At Lake County Car Dealerships
Car accidents remain one of the main causes of serious injury and death for workers in the United States. According to the National Safety Council, “Injuries resulting from roadway incidents involving motorized land vehicles is the leading cause of work-related deaths. In 2022, 1,369 workers died and in 2021-2022, 68,560 DART cases including 54,830 DAFW cases were reported.” There are a number of steps that businesses should take to protect their workers from car accidents.
- Businesses should develop and implement a safe driving policy.
- Businesses should provide regular training sessions to educate workers on safe driving practices.
- Businesses should ensure that all of their vehicles are regularly inspected and well maintained.
When a worker is injured on the job, they will typically have recourse through worker’s compensation. The worker’s compensation system in Illinois is based off of a no-fault insurance scheme. There is no need for an injured worker to demonstrate liability after any accident. A worker may also be able to recover damages through a third party liability claim.
A third party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident. For example, the company responsible for moving and transporting vehicles to a car dealership could be liable if they hit a worker. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver shall exercise due care to avoid hitting any pedestrian in the roadway. Victims of car accidents tend to suffer very serious injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
The vast majority of pedestrian accidents in a workplace are preventable. They tend to happen when drivers are not paying adequate attention to their surroundings. Sadly, though, companies will often do everything in their power to deny responsibility if one of their drivers causes an accident. This is one of the reasons it is important to seek legal counsel early on if you’ve been injured at work.
