Liability for Hampshire Lawnmower Accidents
When a worker is injured in Illinois, they would typically have recourse through the workers’ compensation system. This is a no-fault insurance scheme that allows injured workers to recover damages regardless of who may have caused an accident. In addition to workers’ compensation, injured workers may be able to recover damages through a third-party liability claim. There could be numerous sources of third-party liability for any lawnmower accident.
- Subcontractors: Construction and landscaping projects are typically made up of a blend of different companies that must work together. If the entity that caused an accident was separate from a worker’s employer, they could be held at fault.
- Lawnmower Company: The company that manufactured a lawnmower could be held at fault for an accident if it was caused by a design defect. Lawnmowers should have certain types of safety features to prevent accidents. When they lack these features, this could make them needlessly dangerous.
It is important that accident victims seek medical support as soon as possible after any workplace accident. They should also let their doctors know that they were injured on the job. There are statutes of limitations associated with pursuing injury claims. Failing to act within the statute of limitations can prevent victims from being able to recover damages.
Preserving Evidence After Any Lawnmower Accident
Preserving evidence is an important step after any accident in the workplace. Evidence can help reveal who may be at fault for what happened. What follows are just a few of the pieces of evidence that should be adequately secured and reviewed.
- Photos: It is important that pictures of the accident site are taken.
- Medical Records: A victim’s medical records can help establish the full extent of their injuries.
- Police Report: The police report of the accident should be reviewed. It will normally contain an officer’s first impressions of what happened.
- OSHA Report: The Occupational Safety and Health Administration (OSHA) will also normally conduct an investigation into any workplace accident.
It can be difficult to know where to begin after any workplace accident. Victims are often left with serious injuries that impair their ability to work and simply live a normal life. Accident victims should take time to consider all of their legal options. They should seek the guidance of an experienced personal injury attorney.
