Liability In Des Plaines Industrial Accidents

Manufacturing is very dangerous despite numerous improvements aimed at worker safety. According to the Centers For Disease Control, “An estimated 13,455,000 workers in manufacturing industries are at risk for fatal and nonfatal injuries. Occupations within the Manufacturing sector account for 5% of U.S. workers, and 8% of workplace fatalities.” Metal fabrication, in particular, accounts for some of the highest rates of injury and death within all manufacturing fields. There are a number of steps that companies should take in order to reduce accidents and injuries.

  • The premises of all manufacturing plants should be reasonably safe.
  • Workers should receive adequate safety training to recognize hazards.
  • Workers should be trained in the proper lock-out/tag-out procedures.
  • Workers should always communicate clearly with one another.
  • Workplace equipment should be properly maintained.

Any person that is injured on the job in Illinois may have recourse through a worker’s compensation claim. Worker’s compensation is a no-fault insurance program that can help with medical bills, lost wages and disability benefits. It’s important to let your employer know as soon as possible if you’ve been injured on the job. Depending on the facts of any case, an injured worker may be able to seek benefits through a third-party liability claim.

A third-party liability claim may be possible when an entity separate from a worker’s employer contributed to an accident. For example, the manufacturer of a piece of machinery used in metal fabrication could be held liable through a civil claim. Companies have a legal obligation to create products that are reasonably safe and must warn about the non-obvious dangers associated with the use of their products. Some pieces of machinery lack adequate safety guards that could lead to a worker becoming entrapped. There are many steps that should be taken after any industrial accident.

  • Eye witnesses should be interviewed.
  • The machinery involved should be examined.
  •  Surveillance footage should be sought.
  • A thorough, independent investigation should be conducted.

Any worker that is injured on the job may be able to seek aid through a civil claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. An Illinois industrial accident attorney can examine all of the unique facts of your case and let you know if you have a claim that can be pursued. It is important to act within the statute of limitations. Failing to act within the statute of limitations may result in a permanent forfeiture of your rights.
