Liability For Marengo Industrial Accidents

Despite numerous improvements in workplace safety standards, far too many workers are killed or seriously injured every year. According to the National Safety Council, “The large increase in preventable work death in 2021 is partially a result of a 5% increase in the hours worked resulting from the economic recovery from the COVID-19 pandemic. The increase in hours worked does not fully account for the increase in work deaths.” There are a number of steps that employers should take to protect workers from injury and death.

  • All workers should be well trained to identify workplace safety hazards.
  • All equipment at manufacturing plants should be regularly inspected and well maintained.
  • The premises of every business should be maintained in a reasonably safe condition.

When a worker is injured on the job, they will typically have recourse through worker’s compensation. The worker’s compensation system in Illinois is based off of a no-fault insurance scheme. There is no need for an injured worker to demonstrate liability after any accident. Depending on the facts of any case, an injured worker may also be able to seek aid through a third party liability claim.

A third party liability claim may be possible when an entity separate from a worker’s employer contributed to an accident. For example, the company that manufactured a machine designed to hold molten metal may not have designed their product safely. Liquid metal explosions tend to happen when contaminants enter into liquid metal solutions. There are a number of steps that should be taken after any workplace accident.

  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • A thorough investigation should be conducted.

It can be hard to know where to begin after any workplace accident. However, it is important for accident victims to know that they do have rights. Any person that is injured while on the job may have legal recourse through a civil claim. It is essential that all evidence is properly preserved after any accident.
