Liability for Marengo Workplace Accidents

When a worker is injured in Illinois, they will typically have recourse through the workers’ compensation system. Workers’ compensation in Illinois operates through a no-fault insurance plan. There is no need for an injured worker to demonstrate that one party acted negligently. In addition to workers’ compensation, an injured worker may have recourse through a third-party liability claim. There could be numerous sources of third-party liability for any workplace accident.

  • Machine Manufacturer: The company that manufactured a piece of machinery could be liable for an accident through a product liability claim. In particular, a piece of machinery may have design defects that contribute to a fire.
  • General Contractor: The company responsible for safety at a worksite could potentially be liable for an accident if this entity is separate from a worker’s employer.
  • Subcontractors: Worksites are typically made up of a blend of different companies that must all work together towards the same goal. If a third-party subcontractor acts negligently and causes an accident, their employer could be held at fault.

Workplace accidents are typically very complex. The factors that contribute to any accident could take place hours, days, or weeks beforehand. Many of these accidents are highly preventable. They tend to involve OSHA violations. In particular, workers may not be trained in the proper lockout/tagout procedures. Machines may not get the required maintenance that they need to run safely.

Steps to Take After Marengo Workplace Accidents

Fires remain a major cause of serious injury and death at manufacturing sites across the United States. According to the National Fire Protection Association, “From 2017–2021, United States fire departments responded to an estimated annual average of 36,784 fires at industrial or manufacturing properties (including utility, defense, agriculture, and mining properties).” Victims of workplace fires should take a number of measures to protect their legal rights.

  • Medical Evaluation: Workers should seek a medical evaluation as soon as possible. Many of the injuries associated with a workplace accident may not be immediately obvious.
  • Evidence Preservation: All of the evidence associated with the accident should be preserved. Lots of photos of the accident site should be taken.
  • Report the Accident: Workers should notify their supervisor as early as possible after it happened. It is also a good idea to get a copy of the written incident report.
  • Legal Support: Workers should seek the guidance of an experienced personal injury attorney. An attorney can examine the unique facts of your case and let you know what your legal options are.

It can be difficult to know what to do after any workplace accident. Many victims are so seriously injured that they may need to take months of time off work. They could also be left with high medical bills. Finding sources of third-party liability for workplace accidents is an important part of ensuring workers are able to be fairly compensated for their injuries.
