Liability For Gurnee Skid Steer Accidents
Construction equipment like skid steers are involved in many workplace accidents each year. According to the National Safety Council, “Injuries resulting from contact with objects and equipment is the third leading cause of work-related death, the second leading cause of DART cases, and the third leading cause of DAFW cases.” Businesses should take a number of measures in order to avoid accidents with construction equipment.
- All companies should provide their workers with adequate training. Some machinery will require that workers are certified in order to use them.
- Companies should conduct regular safety inspections on all equipment in order to identify malfunctions and defects.
- Companies should establish and enforce clear safety protocols related to the use of heavy machinery.
- Companies should ensure that workers have effective communication systems.
When a worker is injured on the job, they will typically have recourse through the worker’s compensation system. Worker’s compensation in Illinois operates through a no-fault insurance scheme. Depending on the facts of any case, an injured worker may also be able to seek some measure of justice through a third-party liability claim. A third-party liability claim may be possible when an entity separate from a worker’s employee contributed to an accident. There could be numerous sources of third-party liability for an accident involving a skid steer.
- Equipment Manufacturer: If a skid steer has a design defect that contributed to an accident, this could form the basis of a product liability claim.
- Equipment Rental Companies: Construction equipment is often provided by rental companies. If these companies fail to properly maintain a piece of equipment like a skid steer, they could face liability for an accident.
- Property Owners: A property owner could be liable for a collision if it was caused by a dangerous condition on their property.
It can be hard to know where to begin after any workplace accident. Workers may need to take extensive periods of time away from work. Many workers are so seriously injured that they may never be able to return to their previous profession. They may also be left with high medical bills. Any person injured in a workplace accident involving a skid steer may be able to seek some measure of justice through a civil claim.
