Liability for Round Lake Industrial Accidents

Workers have a variety of legal options when they are injured on the job. Most workers will be able to receive compensation through the workers’ compensation system. This system provides aid to workers, regardless of who may have been at fault for an accident. Injured workers may also be able to pursue damages through a third-party liability claim if an entity separate from their worker contributed to what happened. There are numerous sources of third-party liability for any industrial accident.

  • Contractors: It is common for many businesses to rely on a blend of contractors and subcontractors to complete projects. If an entity separate from a worker’s employer contributed to an accident, they could be legally responsible for a worker’s injuries.
  • Equipment Manufacturer: The company that manufactured a piece of equipment could also be liable for an industrial accident. Industrial machinery should typically have certain safety measures designed to protect users from being seriously injured. This includes guardrails and automatic shut-off features.

Many lawsuits have been pursued against equipment manufacturers after workers have been injured on the job. Consider, for example, Thakore v. Universal Machine Co. of Pottstown, Inc. A worker was seriously injured after a machine’s heat seal press malfunctioned. This resulted in a 200-pound plate dropping on the worker’s hand, which caused severe burns and other injuries. A jury later found that the latch holding the plate back was defective.

Preventing Round Lake Industrial Accidents

Many workers are injured or killed in industrial accidents every year. According to the Centers for Disease Control, “[In 2022], [t]here were 5,846 fatalities, and 2,066 were transportation related. Fatalities that were likely machinery related (contact with objects and equipment) accounted for 738 out of 5,846 total (12.6%).” Employers should take several actions to protect workers from industrial accidents.

  • Risk Assessment: Employers should conduct a risk assessment that identifies potential hazards on the job site. This may include machinery, chemicals, tools, and work practices.
  • Machine Guards: Employers may need to install machine guards on certain pieces of equipment. Many pieces of industrial equipment should also have emergency stop mechanisms.
  • Safety Equipment: Employers should provide workers with adequate personal protective equipment (PPE). Helmets, goggles, respirators, and other equipment can all go a long way towards preventing injuries.

The vast majority of workplace accidents are preventable. They tend to involve situations where safety practices are not being followed. Another major contributing factor is unsafe equipment. Any person injured in an industrial accident may be able to seek some measure of justice through a personal injury claim. A personal injury attorney can examine all of the unique facts of your case free of cost and let you know what your legal options are.
