Liability for Midlothian Car Accidents
Motorcyclists have a naturally small profile, and their drivers must exercise a great deal of care to avoid accidents. Many motorcycle accidents involve drivers that make unsafe lane changes. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-709, “A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety.” Drivers should take several actions to avoid collisions.
- Speed: Drivers must maintain a safe speed at all times and take into consideration the prevailing traffic and weather conditions.
- Rest: Getting enough sleep and rest is an important part of being a safe driver. Drivers are substantially more likely to be involved in a collision if they are fatigued.
- Blind Spots: drivers should check their blind spots before changing lanes or turning at an intersection.
If a driver fails to slow down to avoid a collision with a motorcyclist, this may be construed as negligence. Depending on the facts of any case, there could be liable parties beyond any driver who is going to be responsible. This is particularly true if a commercial vehicle was involved in a collision. The company responsible for the operation of the commercial vehicle could be liable for an accident if it was being used for business purposes at the time.
Steps to Take After a Cook County Motorcycle Accident
Car accidents are often highly preventable and tend to involve some amount of human error. According to the Center for Internet and Society, “Some ninety percent of motor vehicle crashes are caused at least in part by human error. This intuitive claim is a fine place to start discussions about the safety potential of vehicle automation.” It is important that certain actions are taken after any car accident.
- The police should be called to the scene as early as possible so they can begin an investigation.
- The contact information of eyewitnesses should also be sought.
- Photos and surveillance footage of the accident site should be collected.
- An independent review of the collision should be performed by a team with experience in tort claims.
Car accidents can often be highly complex events. The factors that contribute to any particular collision might take place many days or weeks beforehand. These crashes could also involve several liable parties. However, those responsible will virtually never admit fault. It is more likely that they will blame the victim. Family members of any person who died in a car accident may be able to seek some measure of accountability and transparency through a civil action.
