I was Reinjured and Have Lost Everything

Question:

07/28/2000 – threw Bad Order Switch that threw me for a loop and had to have c5 and c6 fused and also found severe carpal tunnel in both hands.
Feb 2001 – Dr. Durward fused c5 to c6 using a plate and did carpal tunnel release on left hand.
May 2001 – did carpal tunnel release in right hand.
Nov 2001 – truck on the highway turned right in front of me in a 50 MPH zone. Wreck caused break of c5 and c6 fusion and had to do the c6 to c7 fusion done Feb. 2001.
Had deposition around this time last year with BNSF now they want another on the 18th of this month and my lawyer says he cannot represent me anymore (he said conflict of character). I just wanted answers to my questions. we are talking the rest of my life here. I cannot even get a job at McDonald’s.
09/30/2002 – Dr. Durward (Nuerosurgeon) found me permanently disabled. I have already applied for RR Disability a couple of months ago. My court date is 12/03/2002 in Des Moines, IA.
I cannot go on anymore – I had to close my $640,000.00 business because I could not do anything but the bookkeeping. My wife then left me in April 2001, divorced April 30, 2002. I could no longer supplement my income to help it in time of need. Without the $70,000.00 railroad job we had nothing. I need immediate attention for the next couple months.
If this lawyer does not show for the deposition do I have any recourse with him not attending? I was also told that he would go over my case file with whomever I choose. I do not want to take this individual off the case because he knows it so well. We have had arguments but I am the one who is permanently disabled – my family leaves me, I lose my business, I have made commitments for payments to be made in Dec.

Answer:

Your story is one of individual devastation. You are suffering from the effects of injury that the public does not get to see, the press ignores, the insurance companies ignore and the conservative establishment ignores.
Your current attorney must feel the case is too difficult for him. If that is the case, then why not find another lawyer? If you don’t have a truck accident lawyer that wants to fight for you, then get another lawyer. You would be amazed at the difference a great trial lawyer makes. He recognizes some of the things that your saying, like, your whole life is at stake here and you are up against powerful interests.
I wish I could help you with your case, but we are not licensed to practice in your state. Find a great trial lawyer before you attend your next deposition. Do not attend a deposition without the right lawyer.
