Injured Worker Rightfully Paid
After fighting the employer and their insurance carrier at every level, Horwitz, Horwitz & Associates has won a solid victory for working people throughout the State of Illinois.
The employer, Interstate Scaffolding, fired the injured worker, Jeff Urban, and then refused to pay benefits, claiming that Mr. Urban had been fired “for cause.”
Horwitz attorney Marc A. Perper convinced the Illinois Supreme Court to reverse this decision and force the employer to pay the injured worker his benefits.
The Illinois Supreme Court agreed to review the case, and on January 22, 2010, the Court reversed the appellate court’s decision and reinstated Mr. Urban’s award of TTD benefits.
The court stated, “an employer’s obligation to pay TTD [Workers’ Compensation] benefits to an injured employee does not cease because the employee [was] discharged—whether or not the discharge was for ‘cause.’”
Attorney Marc Perper — “Horwitz, Horwitz & Associates fought this battle at Arbitration, before the Commission, in the Circuit Court, the Appellate Court, and finally the Illinois Supreme Court. Thanks to this decisive victory, injured workers who are fired will be entitled to receive Workers’ Compensation benefits, even if the employer claims they were fired “for cause.”
