Liability for Illinois Car Accidents

Speed remains one of the most common causes of fatal collisions. According to the NHTSA, “For more than two decades, speeding has been involved in approximately one-third of all motor vehicle fatalities. In 2023, speeding was a contributing factor in 29% of all traffic fatalities.” Speeding can increase the likelihood or severity of a collision in numerous ways.

  • Stopping Distance: Speeding can dramatically increase the time it takes for a vehicle to come to a safe stop.
  • Injury Severity: Higher-speed collisions are substantially more likely to result in serious injuries and deaths.
  • Stability: Vehicles become much more unstable at higher speeds.

All drivers have a legal obligation to exercise caution in order to avoid causing accidents. Pursuant to 625 ILCS 5/11-601, no person may operate a motor vehicle at a speed greater than would be reasonable or safe given the prevailing conditions of the roadway. If a driver fails to slow down in order to avoid hitting another vehicle, this could form the basis of a negligence claim.

It is also possible that liability could extend beyond any driver. If the driver that caused a collision was working at the time, their employer could potentially be vicariously liable. In general, employers are vicariously liable for the wrongful actions of their employees—insofar as those employees were working within the course and scope of their job duties. Victims of car accidents tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage
  • Death

Car accidents are often highly preventable. It has been estimated nearly 93% of all collisions involve some amount of human error. This may involve speeding. It may also involve drivers that are simply following the lead vehicle ahead of them too closely. Whatever the reason an accident took place, victims will typically have recourse through a civil claim. A civil claim can help accident victims recover for many of the ways that an accident has negatively impacted their life and health.
