Liability For McHenry County Bus Accidents
Thousands of people are injured every year in bus accidents. According to The Journalist’s Resource, “on average, about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury. About 50 passengers (including the driver) are killed, on average, in a given year.” There are a number of reasons that buses can be particularly dangerous for those in smaller vehicles.
- Buses have large blind spots that may obscure the presence of smaller vehicles.
- Buses have a wide turning radius and are much more likely to be involved in side-impact collisions.
- Buses weigh substantially more than other vehicles and are dangerous at low speeds.
Buses are considered common carriers, and their drivers are held to a high standard in terms of safety. Many bus collisions involve drivers who are speeding. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-601), all drivers must not operate their vehicles at a speed greater than what would be reasonable or safe given the prevailing conditions of the roadway. If a driver fails to slow down in order to avoid hitting another vehicle, this could form the basis of a negligence claim. Victims of bus accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Organ damage
Depending on the facts of any case, liability for any bus accident could extend beyond any driver. The company or municipal entity that operated a bus could be held at faulty. Generally speaking, employers are vicariously liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Any person injured in a bus accident may be able to seek some measure of justice through a civil claim.
